Our data collection and use policies with respect to the Site are set forth in this statement ("Policy"). By using this Site, you signify your acceptance of this Policy.

When reviewing this Policy you should understand that when we use the term "personally identifiable information" we mean any information that can be used to identify or contact a specific individual, such as a name, address, telephone number or e-mail address. We shall have no responsibility or liability for your visitation to, and the data collection and use practices of, those Web sites.

We will not intentionally share your personally identifiable information with unaffiliated entities (i) except as described in this Policy or as disclosed at the time your personally identifiable information is provided, or (ii) without your consent. We do, however, share aggregate information about Members and visitors to our Site with third parties and we share visitor and Member personally identifiable information with companies with whom we have a marketing or other business relationship.

We may disclose personally identifiable information and aggregate information in order to (1) comply with applicable laws, (2) respond to governmental inquiries, (3) comply with valid legal process, and (4) protect the rights or property of JEFL.

In the event there is a change in the corporate structure of JEFL such as, but not limited to, merger, consolidation, sale, liquidation, or transfer of substantial assets, JEFL may, in its sole discretion, transfer, sell or assign information collected on and through this Site, including without limitation, personally identifiable information and aggregate information concerning visitors, to one or more affiliated or unaffiliated third parties.

Certain activities and services available on the Site are provided by third parties. For example, if you choose to purchase a product from us, we may use an outside vendor to process and ship the order to you. In this instance, we would need to provide your shipping address to this entity. We may also utilize an outside e-mail service provider to send our e-mails, in which case we would need to provide your e-mail address to this vendor.

Color Disclaimer:

Although we do our best to make sure that the colors on our web site are accurate, actual colors will vary. Subtle color differences and textures may not be fully appreciated on some systems due to differences in monitors and/or display cards.

Returned Goods and Claims Policies

J. Ennis Fabrics Ltd. maintains the highest standards possible in the textiles and supplies we present to our customers. The following are the standards we use for shipping to our customers. These standards are based on the "Woven Upholstery Fabric Standards and Guidelines (2nd Edition)" and the Chemical Fabrics and Film Association's paper on Standard Test Methods for Chemical Coated Fabrics and Films which are sources subscribed to by most North American manufacturers. These books specify test methods, practices and minimum voluntary acceptance guidelines for various types of upholstery fabrics and standards for vinyls and coated fabrics. In no case would we supply items as first quality that could not meet these guidelines. Clearouts or seconds are of a lower standard and are priced accordingly.

Allowances

The following allowances will be made for fabric flaws:

Marking of Flaws

Top

Factory flaws are marked with either a red or yellow plastic "swiftach" type of marker or a length of colored thread or string in the selvedge of the material. When marked with a red tag, the flaw is considered to be a "spot" or filling (course) direction flaw. It usually will be less than 1/8 yard and is marked with the red tag for identification and numbering of flaws per roll. When a yellow flag is used, this represents a warp or wale direction flaw, and there is a flag to mark both the start and end of the flaw. In most cases a flaw of this type would not be included in your shipment, but in case of a full roll order the exact yardage between flags is deducted from the gross yardage on the roll.


Flaw Density

Top

This refers to the acceptable number of flaws in a given cut. A maximum of one flaw per 5 yards is allowed. If the cut is equal to or under 5 yards, then the cut must be free of flaws.

Break in Rolls

Top

A break in a roll is considered to be a flaw and the allowance given is usually 2/8 to 4/8 yard. All orders 10 yards or less must be filled with a single piece of fabric. If this is not possible then the customer must approve shipment ahead of time. If the length of the cut is greater than 10 yards, a break is acceptable provided there is a suitable allowance. No single piece will be less than 2 flaw free yards. If more than 2 pieces are required to fill an order, the customer must approve this prior to shipping, regardless of length. In all cases of breaks in rolls this information must be noted on the stop tag as well as the packing slip.


Shade and Dye Lot

Top

Any time two or more pieces are used to fill an order, the goods must match. Customers will be advised if shade and dye lots cannot be matched.

Roll lengths vary. Please confirm when placing orders for full rolls.


Clearouts

Clearouts or seconds may contain flaws and have been priced accordingly.

Top

Payment terms are Net 30 days from date of invoice. Shipments in Canada are F.O.B. Victoria, Vancouver, Edmonton, Calgary, Regina, Saskatoon, Winnipeg, Toronto, Ottawa, Hull, Montreal and Quebec City.

Shipments in the U.S. are F.O.B. warehouse


Overdue Accounts

Top

A 1.5% service charge per month (18% per annum) will be charged on overdue accounts.


Ordering

Top

When placing an order please provide the following information: pattern name, color number, and shipping instructions.

If exact color match is required, please request a cutting of present stock, or send a cutting to be matched. If matching a previous order, please quote the order number. If this is unavailable, send a cutting of the fabric for matching. Please note that dye lots may vary.


Back Orders

Top

Back ordered items will be shipped as soon as available unless otherwise advised by customer.


Reserved Orders

Top

Reservations placed on fabric orders will be honored for 48 hours.


Lost Goods

Top

Customers must advise J.Ennis Fabrics Ltd. / USA Inc. within 90 days of a shipping date that goods are lost in shipping, and a claim is required. We cannot honor any freight claims past this point.


Showroom Samples

Top

A deposit of twenty dollars ($20.00) per sample and a deposit of one hundred dollars ($100.00) per complete sample book will be collected at the time a customer completes a "Sample Loan Out Sheet". All samples are expected to be returned to our showroom within 2 weeks at which time your deposit will be returned to you. If samples are not returned within 4 weeks the deposit will be forfeited.

Fabric Warranty

Top

J. Ennis Fabrics Ltd. / J. Ennis Fabrics USA Inc. fabrics will be repaired or replaced if they fail to give normal wear for two years from date of delivery.

This warranty expressly does not cover:

Cuts Burns Damage caused by improper installations or applications
Stains    Pet Damage    Damage caused by unreasonable use
Pilling Soiling Fading caused by sunlight (unless product specified UV resistant)

Claims will not be honored when covers have been removed for cleaning. This warranty does not apply to fabrics treated with non-fluorocarbon finishes. If the identical fabric is not available, J. Ennis Fabrics Ltd./ J. Ennis Fabrics USA Inc. will provide an equivalent fabric.

Each cut of fabric is accompanied by a tag describing the item ordered and the yardage shipped. These tags also contain information regarding flaws, the date and time of the order, the packing slip number, etc. Please read these tags thoroughly. Whenever the Quantity Ordered and the Quantity Shipped differ, there will be a mark denoting whether the cause was a flaw, an allowance or a given fabric situation.


Given

Top

Indicates that there was a small amount of yardage left on the roll and was forwarded to the customer at no charge.


Flawed

Top

Indicates that there were imperfections within the yardage (as outlined in Quality Control Standards), therefore extra fabric has been allowed for them.


Allowance

Top

Indicates that you have been allowed extra fabric for a latent warp direction flaw.


Description and 'Tag-For' Comments

Top

Will also help to identify the goods. Be sure to check these before cutting the material. The cutting of a fabric indicates acceptance. Fabric may not be returned for credit once it has been cut or marked. As well, any supply item sold in pre-packaged lots will not be accepted in less than complete lots.


Returns

Top

In order to process your credits more efficiently, we are instituting the following policy. To process the credit more quickly, customers are now required to request a Return Authorization Number (RA) for all returns to our office. This will enable credits status inquiries to be handled more efficiently by our Call Centre Agents, and will help us identify lost or mislabeled returns. Should an RA number not be received it will cause the process of the credit to be delayed, or even refused. A 15% restocking charge (plus freight it applicable) will be charged on all returned goods.


The following restrictions will apply to returned goods:
  1. Returns will not be accepted on goods older than 90 days from date of purchase.
  2. Returns will not be accepted after fabric has been cut.
  3. No returns accepted on fabric cuts under 5 yds.
  4. Returns goods must be packaged properly. If further damage occurs from inadequate packaging further charges would apply.
  5. Adhesives are not accepted after 30 days because of shelf life.
  6. Mfg warranties apply to the repair of all tools

The exception to the above occurs when it is determined the reason for the return is an error on the part of J. Ennis Fabrics. In this case no restocking or freight charges would apply.

Warranty Claims

Top

Warranty periods vary by manufacturer and product. If you have a question or concern regarding the warranty on a purchase or an existing product in use, please contact your sales representative or our call centre. All warranty claims are handled on an individual basis. To initiate a claim, contact your sales representative to get a claims form filled out and submitted. Due to the wide range of manufacturers and suppliers there is no standard for claims.
